IVQ vs. Ruben Barbasa

Facts:
The case was about a disputed land bought by Ruben Barbasa from a the vendor, Therese Vargas,
It was alleged by Barbasa, that he took possession of the disputed property immediately after the transfer certificate of title and deed of absolute sale was produced in favor of him. Later, Barbasa found out that the subject property was previously registered in the name of Kawilihan corp, and that such property is was also sold to another person, Jose Vargas, who also sold it to IVQ land holdings. Aggrieved by the foregoing facts, Barbosa filed for Quieting of Title and cancellation of IVQ’s registration, and stated that; he was a buyer in good faith who have it registered and took possession of the disputed land.
RTC granted Barbasa’s petition, CA affirmed the decision of the RTC.
After the decision of the CA, IVQ was able to produce additional evidence which was not available at the earlier stage.
IVQ then filed a petition for certiorari.
ISSUE:
Does IVQ’s petition has merit.
HELD:
SC ruled that; based on the newly discovered evidence presented by IVQ, the case must be reassess and re-evaluated. Therefore, the case was remanded to the CA for the purpose of hearing and receiving the new evidence presented by the parties.
